Abstract

Artikel ini bertujuan merumuskan parameter normatif-penologis untuk menyeimbangkan rehabilitasi dan kedaulatan pemidanaan dalam transfer narapidana narkotika, serta memetakan kendala yuridis dan desain pengaturan yang diperlukan guna menjamin kepastian hukum dan perlindungan hak para pihak. Penelitian ini menggunakan metode hukum normatif dengan pendekatan perundang-undangan, konseptual, dan komparatif terbatas terhadap instrumen model internasional, praktik perjanjian transfer, serta standar perlakuan narapidana. Temuan utama menunjukkan bahwa desain pengaturan perlu mengunci (i) rehabilitative nexus berbasis RNR, (ii) equivalence dan continuity of care sebagai standar minimum, serta (iii) hard safeguards berupa informed consent terverifikasi, prinsip non-aggravation, dan filter HAM minimum (termasuk non-refoulement). Artikel ini mengusulkan rancang bangun norma yang membakukan syarat kelayakan, prosedur consent, serah-terima klinis, grounds for refusal, dan mekanisme monitoring pasca-transfer sebagai prasyarat keseimbangan rehabilitasi dan kedaulatan pemidanaan.
